logo certificación energéticaSince 2007 with the entry into force of the Technical Building Code and Royal Decree 47/2007 of January 19, the Energy Certification of Buildings of new construction is already mandatory, in such a way that forces sellers and lessors Of the buildings to provide a certificate of Energy Efficiency.

As we informed you in our real estate bulletin number 19, of May 7, the buildings will be required to have a Certificate of Energy Efficiency. Obligatory for any purchase or sale, housing or local. To be provided by the owner.

This certificate is issued by a competent technician (architect, technical architect, engineer and / or technical engineer), has a validity of 10 years and must be submitted to the competent body of the autonomous community to which it belongs, which will create a Certificate of Efficiency Certificates Energetics.

The certificate will propose improvements to obtain a better certification, these improvements will not be mandatory at the moment. If the owner makes them, he can request a new certificate with the new rating.

 

GENERAL CONCEPTS:

1. Buildings required to obtain the certificate:

  • A. All those that are object of contract of sale or rent.

The certificate, which results in a tag, states: “The label must be included in any offer, promotion and advertising directed at the sale or rental of the building or building unit. It must always be clearly and unequivocally labeled if it refers to the project’s energy efficiency certificate (in the case of a housing development which is not completed) or to a finished building ”

2. Buildings excluded from obtaining the certificate:

  • A. Open buildings (Example: porches)
  • B. Buildings and monuments officially protected, when compliance with such requirements could unacceptably alter their character or appearance.
  • C. Buildings used as places of worship or religious activities.
  • D. Provisional constructions with an intended use period of two years or less.
  • E. Industrial and agricultural buildings, in the part destined to workshops, non-residential agricultural and industrial processes.
  • F. Isolated buildings with a total useful floor area less than 50 m2.
  • G. Buildings of poor technical simplicity and small constructive entity that do not have residential or public character, are developed in a single one in a single plant and do not affect the security of the people.
  • H. Buildings that are purchased for major renovations or to be torn down.
  • I. Residential buildings which are the subject of a rental contract for less than four months a year.
