ENERGY CERTIFICATE IN RESIDENTIAL HOUSING?

The regulations do not specify exactly whether the tourist apartment or holiday homes according to their regulation in Catalonia are subject to this regulation on energy efficiency. Although the following should be taken into account:
A tourist apartment building is not a dwelling, but a tourist accommodation establishment so we understand that it is not subject to this certificate of energy efficiency.
On the other hand, a housing for tourist use, is a modality of accommodation in dwellings, therefore, it does not cease to be a dwelling in which there is an economic activity and as such would be subject to these regulations, except that the housing for tourist use it is an isolated building with a total useful floor area of ​​less than 50 m2 or that the use of this dwelling is less than four months a year or for a limited period of the year and with an estimated energy consumption of less than 25% which would result from its use throughout the year.
In these latter cases, it would be saved the fact of not having an energy efficiency certificate with a responsible statement from the homeowner.
Inexcusably, the houses that are rented by contract of season or like permanent house subject to the Law of Urban leases, must have this certificate of energy efficiency from the 1 of June of 2013.
